Terms and Conditions – Sherlock’s Place

These Terms and Conditions apply to all offers, orders and agreements of Sherlock’s Place, established in the Netherlands and operating through the webshop www.sherlocksplace.nl. By placing an order, you agree to these Terms and Conditions.


Article 1 – Definitions

  1. Entrepreneur: Sherlock’s Place, established in the Netherlands, trading under the name Sherlock’s Place.

  2. Consumer: a natural person who is not acting in the course of a profession or business and who enters into an agreement with the entrepreneur.

  3. Business customer: a natural person or legal entity acting in the course of a profession or business.

  4. Agreement: any agreement concluded between the entrepreneur and the customer via the webshop.

  5. Products: all goods offered via the webshop, including (but not limited to) syrups, beverages and accessories.


Article 2 – Applicability

  1. These Terms and Conditions apply to every offer made by the entrepreneur and to every distance agreement concluded.

  2. Deviations from these Terms and Conditions are only valid if agreed in writing.

  3. If one or more provisions of these Terms and Conditions are invalid or voidable, the remaining provisions shall remain fully in force.


Article 3 – The Offer

  1. All offers are without obligation, unless explicitly stated otherwise.

  2. The entrepreneur makes every effort to describe the products as accurately and completely as possible.

  3. Obvious mistakes or errors in the offer are not binding on the entrepreneur.


Article 4 – The Agreement

  1. The agreement is concluded at the moment the customer accepts the offer and meets the stated conditions.

  2. After placing an order, the customer will receive an order confirmation by e-mail.

  3. The entrepreneur reserves the right to refuse orders or to attach additional conditions to an order.


Article 5 – Prices

  1. All prices are stated in euros and include VAT, unless stated otherwise.

  2. Any shipping costs will be clearly stated before the order is completed.

  3. The entrepreneur reserves the right to change prices. Price changes do not affect agreements already concluded.


Article 6 – Payment

  1. Payment must be made using the payment methods offered in the webshop.

  2. Orders will be processed after successful receipt of payment.

  3. In the event of non-payment, the entrepreneur is entitled to dissolve the agreement.


Article 7 – Delivery

  1. Delivery takes place at the address provided by the customer.

  2. The entrepreneur aims to deliver within the indicated delivery period; this period is indicative.

  3. If delivery is delayed, the customer will be informed as soon as possible.


Article 8 – Right of Withdrawal (Consumers)

  1. The consumer has the right to withdraw from the agreement within 14 days after receipt of the product, without giving any reason.

  2. The right of withdrawal is excluded for:

    • products which cannot be returned for reasons of hygiene or food safety if the seal has been broken;

    • perishable goods or products with a limited shelf life.

  3. During the withdrawal period, the consumer shall handle the product and packaging with care.

  4. The costs of return shipping are borne by the consumer.


Article 9 – Returns and Refunds

  1. After withdrawal, the purchase amount will be refunded within 14 days, provided the product has been received in good condition.

  2. Refunds will be made using the same payment method as used for the original transaction.


Article 10 – Liability

  1. The entrepreneur is not liable for indirect damage, consequential damage or loss of profit.

  2. The entrepreneur’s liability is in all cases limited to the amount of the relevant order.


Article 11 – Complaints

  1. Complaints must be submitted in writing within a reasonable period after discovery.

  2. The entrepreneur will respond substantively to the complaint within 14 days.


Article 12 – Force Majeure

  1. The entrepreneur is not obliged to fulfil any obligation if prevented from doing so due to force majeure.

  2. Force majeure means any circumstance beyond the entrepreneur’s control which makes fulfilment of obligations impossible or unreasonable.


Article 13 – Applicable Law and Disputes

  1. All agreements are exclusively governed by Dutch law.

  2. Disputes will be submitted to the competent court in the Netherlands.
