General Terms and Conditions Sherlock's Place

Article 1 - Definitions
In these conditions the following definitions apply:
Additional agreement: an agreement whereby You acquire products in connection with a distance contract and these goods are delivered by Sherlock's Place or by a third party on the basis of an agreement between that third party and Sherlock's Place;
Reflection period: the period within which you can exercise your right of withdrawal;
Consumer: the natural person who is not acting for purposes related to his trade, business, craft or profession;
Day: calendar day;
Digital content: data produced and delivered in digital form;
Durable data carrier: any tool - including e-mail - that enables You or Sherlock's Place to store information addressed personally to it in a manner that allows future consultation or use for a period appropriate to the purpose for which the information is intended, and which allows unaltered reproduction of the stored information;
Right of withdrawal: the option for you to cancel the distance contract within the cooling-off period;
Sherlock's Place: the webshop where you can buy items.
Distance agreement: an agreement concluded between Sherlock's Place and you in the context of an organized system for the distance sale of products, whereby exclusive or partial use is made of one or more communication techniques up to and including the conclusion of the agreement. at a distance;
Withdrawal form: the European model withdrawal form included in Appendix I of these conditions.
Remote communication technology: means that can be used to conclude an agreement, without the consumer and Sherlock's Place having to be in the same room at the same time.

Article 3 - Applicability
These general terms and conditions apply to every offer from Sherlock's Place and to every distance contract concluded between Sherlock's Place and the consumer.
Before the distance contract is concluded, the text of these general terms and conditions will be made available to you. You will find the General Terms and Conditions on the website at the bottom of the page and they will also be sent as an attachment in the email. If this is not reasonably possible, Sherlock's Place will indicate before the distance contract is concluded how the general terms and conditions can be viewed at Sherlock's Place and that they will be sent free of charge as soon as possible at your request.
In the event that specific product or service conditions apply in addition to these general terms and conditions, the second and third paragraphs apply mutatis mutandis and in the event of conflicting conditions, you can always rely on the applicable provision that is most favorable to him.
Article 4 - The offer
If a product has a limited period of validity or is subject to conditions, this will be expressly stated with the product.
The offer contains a complete and accurate description of the products offered. The description is sufficiently detailed to enable you to properly assess the offer. If Sherlock's Place uses images, these are a true representation of the products, services and/or digital content offered. Obvious mistakes or errors in the offer do not bind Sherlock's Place.
Each product contains such information that it is clear to you what rights and obligations are associated with acceptance of the product.
Article 5 - The agreement
The agreement is concluded, subject to the provisions of paragraph 4, at the time of acceptance by You of the product and compliance with the conditions set.
If you have accepted the product electronically, Sherlock's Place will immediately confirm receipt of acceptance of the product electronically. As long as receipt of this acceptance has not been confirmed by Sherlock's Place, you can terminate the agreement.
If the agreement is concluded electronically, Sherlock's Place will take appropriate technical and organizational measures to secure the electronic transfer of data and ensure a secure web environment. If you can pay electronically, Sherlock's Place will take appropriate security measures.
Sherlock's Place can inform itself within legal frameworks whether you can meet its payment obligations, as well as all those facts and factors that are important for a responsible conclusion of the distance contract. If, based on this investigation, Sherlock's Place has good reasons not to enter into the agreement, it is entitled to refuse an order or request with reasons or to attach special conditions to the execution.
Sherlock's Place will send you the following information at the latest upon delivery of the product, in writing or in such a way that it can be stored by you in an accessible manner on a durable data carrier:
the visiting address of the Sherlock's Place branch where you can go with complaints;
the conditions under which and the manner in which you can exercise the right of withdrawal, or a clear statement regarding the exclusion of the right of withdrawal;
the information about warranties and existing after-sales service;
the price including all taxes of the product; where applicable, the costs of delivery; and the method of payment, delivery or execution of the distance contract;
if you have a right of withdrawal, the model withdrawal form.
Article 6 - Right of withdrawal
You can terminate an agreement regarding the purchase of a product during a cooling-off period of at least 14 days without giving reasons. Sherlock's Place may ask you for the reason for withdrawal, but does not oblige you to state its reason(s).
The cooling-off period referred to in paragraph 1 commences on the day after You, or a third party designated in advance by You, who is not the carrier, has received the product, or:
if you have ordered multiple products in the same order: the day on which you, or a third party designated by him, received the last product. Sherlock's Place may, provided it has clearly informed you of this prior to the ordering process, refuse an order for multiple products with different delivery times.
if the delivery of a product consists of several shipments or parts: the day on which You, or a third party designated by him, received the last shipment or part;
in the case of agreements for regular delivery of products during a certain period: the day on which You, or a third party designated by him, received the first product.
Extended reflection period for products that are not delivered on a tangible medium if you do not inform yourself about the right of withdrawal:
If Sherlock's Place has not provided you with the legally required information about the right of withdrawal or the model withdrawal form, the reflection period will expire twelve months after the end of the original reflection period determined in accordance with the previous paragraphs of this article.
If Sherlock's Place has provided you with the information referred to in the previous paragraph within twelve months after the commencement date of the original cooling-off period, the cooling-off period will expire 14 days after the day on which you received that information.
Article 7 - Obligations of You during the cooling-off period
During the cooling-off period, you will handle the product and packaging with care. He/she will only unpack or use the product to the extent necessary to determine the nature, characteristics and operation of the product. The basic principle here is that you may only handle and inspect the product as you would in a store.
You are only liable for any reduction in value of the product that is the result of handling the product that goes beyond what is permitted in paragraph 1.
You are not liable for any reduction in value of the product if Sherlock's Place has not provided him/her with all legally required information about the right of withdrawal before or at the time of concluding the agreement.
Article 8 - Exercise of the right of withdrawal by You and costs thereof
If you exercise his right of withdrawal, he will notify Sherlock's Place within the cooling-off period by means of the model withdrawal form or in another unambiguous manner.
You will return the product as soon as possible, but within 14 days from the day following the notification referred to in paragraph 1, or hand it over to (an authorized representative of) Sherlock's Place. In any case, you have complied with the return period if he returns the product before the cooling-off period has expired.
You return the product with all accessories supplied, if reasonably possible in the original condition and packaging, and in accordance with the reasonable and clear instructions provided by Sherlock's Place.
The risk and burden of proof for the correct and timely exercise of the right of withdrawal lies with you.
You bear the direct costs of returning the product.
You will not bear any costs for the full or partial delivery of digital content not delivered on a tangible medium, if:
prior to its delivery, he has not expressly agreed to commence performance of the agreement before the end of the cooling-off period;
he has not acknowledged that he loses his right of withdrawal when granting his consent; or
Sherlock's Place has failed to confirm this statement of yours.
If you exercise your right of withdrawal, all additional agreements will be terminated by operation of law.
Article 9 - Obligations of Sherlock's Place upon withdrawal
If Sherlock's Place enables you to notify your withdrawal electronically, it will immediately send a confirmation of receipt after receiving this notification.
Sherlock's Place will reimburse all payments from You, including any delivery costs charged by Sherlock's Place for the returned product, without delay but within 14 days following the day on which You notify him of the cancellation. Sherlock's Place may wait to refund until he has received the product or until you demonstrate that he has returned the product, whichever is the earlier.
Sherlock's Place will use the same payment method that You used for reimbursement, unless You agree to another method. The refund is free of charge for you.
If you have chosen a more expensive method of delivery than the cheapest standard delivery, Sherlock's Place does not have to reimburse the additional costs for the more expensive method.
Article 10 - Exclusion of right of withdrawal
Sherlock's Place can exclude the following products and services from the right of withdrawal, but only if Sherlock's Place has clearly stated this in the offer, at least in time before concluding the agreement:
Products or services whose price is subject to fluctuations in the financial market over which Sherlock's Place has no influence and which may occur within the withdrawal period;
Agreements concluded during a public auction. A public auction is defined as a method of sale whereby products are offered by Sherlock's Place to you who are personally present or have the opportunity to be personally present at the auction, under the supervision of an auctioneer, and where the successful bidder is obliged to sell the products, to confiscate;
Products manufactured to Your specifications, which are not prefabricated and which are manufactured on the basis of an individual choice or decision by You, or which are clearly intended for a specific person;
Newspapers, periodicals or magazines, with the exception of subscriptions thereto;
Article 11 - The price
The prices stated in the range of products include VAT.
Article 12 - Compliance with agreement and additional warranty
Sherlock's Place guarantees that the products comply with the agreement, the specifications stated in the offer, the reasonable requirements of reliability and/or usability and the legal provisions and/or government regulations in force on the date of the conclusion of the agreement.
An additional warranty provided by Sherlock's Place, its supplier, manufacturer or importer never limits the legal rights and claims that you can assert against Sherlock's Place under the agreement if Sherlock's Place has failed to fulfill its part of the agreement.
An additional warranty means any obligation by Sherlock's Place, its supplier, importer or manufacturer in which it grants you certain rights or claims that go beyond what it is legally obliged to do in the event that it has failed to fulfill its part of the agreement.
Article 13 - Delivery and execution
Sherlock's Place will exercise the utmost care when receiving and executing orders for products and when assessing applications for the provision of services.
The place of delivery is the address that you have provided to Sherlock's Place.
Taking into account what is stated in Article 4 of these general terms and conditions, Sherlock's Place will execute accepted orders expeditiously, but no later than within 14 days, unless a different delivery period has been agreed. If delivery is delayed, or if an order cannot be fulfilled or can only be partially fulfilled, you will be notified of this no later than 14 days after the order has been placed. In that case, you have the right to terminate the agreement without costs and the right to any compensation.
After dissolution in accordance with the previous paragraph, Sherlock's Place will immediately refund the amount you paid.
The risk of damage and/or loss of products rests with Sherlock's Place until the moment of delivery to You or a representative designated in advance and made known to Sherlock's Place, unless expressly agreed otherwise.
Article 14 – Payment
Payment by You is made in advance; cash if the items are collected at Grotekerkplein 103 in Rotterdam; via iDeal or by means of an invoice. The latter is only an option for regular customers.
The invoice must be paid by You within 5 days after the start of the cooling-off period
You have the obligation to immediately report inaccuracies in payment details provided or stated to Sherlock's Place.
If you do not meet its payment obligation(s) on time, it is, after Sherlock's Place has informed you of the late payment and Sherlock's Place has granted you a period of 14 days to still meet its payment obligations, after the failure to do so. payment within this 14-day period, statutory interest will be charged on the amount still owed and Sherlock's Place is entitled to charge the extrajudicial collection costs incurred by it. These collection costs amount to a maximum of: 15% on outstanding amounts up to € 2,500; 10% on the next € 2,500 and 5% on the next € 5,000 with a minimum of € 40. Sherlock's Place may deviate from the stated amounts and percentages for your benefit.
Article 15 - Complaints procedure
In case of complaints about a product or delivery, you can do the following:

Come to our visiting address. Grotekerkplein 103 in Rotterdam. from Mon – Sun from 9:00 am to 5:00 pm.
Complaints about the execution of the agreement must be submitted fully and clearly described to Sherlock's Place within a reasonable time after you have discovered the defects.
Complaints submitted to Sherlock's Place will be answered within 3 days from the date of receipt. If a complaint requires a foreseeably longer processing time, Sherlock's Place will respond within 3 days with an acknowledgment of receipt and an indication of when you can expect a more detailed answer.
In any case, you must give Sherlock's Place at least 4 weeks to resolve the complaint by mutual agreement. After this period, a dispute arises that is subject to the dispute settlement procedure.
Article 16 - Disputes
Agreements between Sherlock's Place and you to which these general terms and conditions apply are exclusively governed by Dutch law.
